General conditions
Article 1 General
These terms of delivery apply to all offers of the Amethyst Foundation (hereafter called: Amethyst Press) and to all agreements that are entered into via its Internet site between Amethyst Press and Customer to deliver books and other articles (hereafter: the agreement).
Article 2 Definitions
In these terms of delivery, the following definitions shall apply:
Amethyst Press: Publisher, Snelliuspad 23 in Amersfoort, registered in the Trade Register number 34149661, VAT number: 8095.62.492.B.01
Internet site: the place on the Internet where Amethyst Press offers the possibility of placing an order with it through electronic communication.
Customer: the natural or legal person who made an agreement with Amethyst Press through its internet site to purchase one or more products.
Article 3 Prizes
3.1. Delivery of products happens against the prices and rates mentioned on the internet site at the moment of the realization of the agreement. Prices agreed upon or made known by Amethist Pers or her suppliers in other ways than on the internet site, do not bind Amethist Pers for products ordered through the internet site, unless explicitly agreed upon otherwise in writing between Amethist Pers and Customer.
3.2. All prices and rates used by Amethyst Press are inclusive of VAT, unless explicitly stated otherwise. The mentioned prices do not include shipping costs.
3.3. Amethyst Press reserves the right to change prices for any reason. Amended prices and rates are valid from the moment they are mentioned on the internet site. Errors in price announcements are reserved.
Article 4 Offer, order and formation of agreement
4.1. The agreement is established by an order of Customer through its internet site and acceptance of this order by Amethyst Press.
4.2 The buyer can use her right of withdrawal within 14 working days after delivery of the product. The full amount including shipping costs will be refunded after return receipt of the article by Amethyst Press.
4.3 Amethyst Press will refund the full amount to Buyer once the item is returned within 30 days. This rule does not apply to very specific goods ordered by order of Buyer, or if a different delivery period has been agreed upon.
4.4 If Customer's order for goods to be delivered by Amethyst Press cannot be delivered within 30 days, Customer is entitled to cancel it without any conditions.
Article 5 Delivery
5.1. Ordered products are delivered to the Customer by delivery, in this case: delivery of the goods to the address specified by the Customer for that purpose or, if the goods cannot be received there or left in a mailbox, leaving behind at that address a written notice stating how the addressee can take possession of the goods. The goods are at the Customer's risk from the moment of delivery.
5.2 Amethyst Press is not liable for lost orders or delays that occur during shipping.
5.3. Amethyst Press is entitled to suspend fulfillment of any obligations towards Customer as long as Customer has not met all his (payment) obligations towards Amethyst Press, for whatever reason.
Article 6 Payment
6.1. Invoicing is done by Amethyst Press in principle or simultaneously with the delivery of the ordered goods.
6.2. Payment by Customer is to be made directly through the webshop. For bulk orders within 14 days after delivery on a bank and/or giro account designated by Amethist Pers, unless otherwise (advance) payment has taken place.
6.3. Without explicit written consent of Amethyst Press, Buyer is not allowed to settle any payment obligation towards Amethyst Press with a claim of Buyer on Amethyst Press, for whatever reason.
6.4. Amethyst Press has the right at any time to demand full or partial prepayment, cash payment, or security for payment from Customer.
6.5. In case of exceeding the payment term, Customer is in default without any notice of default being required and Amethist Pers is entitled to charge Customer the legal interest from the due date of the invoice. In that case Amethist Pers is also entitled to claim compensation of all actual judicial and extrajudicial collection costs, which will be calculated according to the collection rates of the Dutch Bar Association.
Article 7 Claims and complaints; right of withdrawal
7.1. You have the right to cancel your order up to 14 days after receipt without giving any reason. You have another 14 days after cancellation to return your product. You will then be credited for the full order amount including shipping costs. Only the return costs from your home to the store are for your own account. These costs are approximately 6.95 per package, for the exact rates please consult the website of your carrier. If you exercise your right of withdrawal, the product will be returned to the entrepreneur with all delivered accessories and - if reasonably possible - in its original condition and packaging. To exercise this right, please contact us at info@amethistpers.nl. We will then refund the order amount due within 14 days of notification of your return provided the product has already been received back in good order."
7.2 Exclusion of the right of withdrawal is possible for products:
1. whose seal has been broken. These products are not returnable.
2. whose opinion on form and content is clearly of a personal nature
3. whose price is subject to fluctuations in the market on which the Amethyst Press has no influence;
4. for audio and video recordings for which the consumer has broken the seal.
Article 8 Liability and indemnification
8.1. The presence of a defect shall never entitle the Customer to suspend or set off its payment obligations in respect of the product.
8.2. The total liability of Amethyst Press because of attributable failure in the obligation to deliver any performance is limited to compensation for direct damage to a maximum amount equal to the price stipulated for that performance (excluding VAT).
8.3. Liability of Amethyst Press for indirect damages, including consequential damages, lost profits, lost savings, damage due to business stagnation and any other damages than those referred to in article 8.2. is excluded.
Article 9 Retention of title
9.1. Amethyst Press retains the property of all (movable) goods delivered by her to Customer until Customer has completely fulfilled all his obligations towards Amethyst Press from any agreement to deliver books or other products, including obligations concerning a shortcoming in the fulfilment of such agreements.
Article 10 Intellectual and industrial property rights
Customer is not allowed (and this applies if necessary in addition to copyright or related rights of Amethist Pers) without prior written consent of Amethist Pers to any book or electronic product delivered and/or made available to Customer by Amethist Pers or any other article offered on her Internetsite, entirely or partially to multiply or publish (reproductions thereof) if this is done (I) for the benefit of a company, organisation or institution (II) for own practice, study or use which is not strictly private in nature or (III) for reproduction in a daily-, news- or weekly newspaper or magazine (whether or not in digital form) or in a broadcast of a radio or television programme, unless explicitly stated otherwise.
Article 11 Force Majeure
Force majeure for Amethyst Press is defined as any shortcoming in the implementation of the agreement that is not due to the fault of Amethyst Press nor by law, legal act or in the generally accepted views for its account, or which is the result of the fact that a product ordered by the Customer is temporarily out of stock at Amethyst Press or its supplier.
